What Counts as an Employee Achievement Award?
Under 26 U.S. Code 274(j), the item must be tangible personal property given for length of service or safety achievement. It must come as part of a meaningful presentation. And it cannot look like disguised pay. Custom rings, engraved plaques, trophies and recognition jewelry all fit.
A meaningful presentation means the company recognizes the person in front of peers or leadership. Leaving the award on a desk or shipping it with no acknowledgment fails that test. The ceremony is what separates the award from ordinary compensation in the eyes of the IRS.
What Never Qualifies
Cash and cash equivalents are out. Gift cards, gift certificates and prepaid debit cards are always taxable wages. Vacations, meals, lodging and tickets to theater or sporting events fail the tangible personal property test. So do stocks, bonds and other securities.
Keep the menu physical. Disguised compensation shows up as Form W-2 fringe benefit reporting and FICA withholding if a payroll review catches it.
How the $400 and $1,600 Limits Work
A nonqualified program excludes up to $400 per employee per tax year. A qualified written plan raises that to $1,600 per employee per year. Anything above the applicable cap becomes taxable wages to the recipient.
The cap is cumulative. Add the cost of every achievement award one employee received in the calendar year, then compare the total to the limit. A $300 plaque in March plus a $200 trophy in November puts you $100 over the nonqualified cap.

De Minimis Gifts Versus Achievement Awards
A de minimis fringe benefit is property or a service of such small value that tracking it is impractical. Holiday gifts of property with a low fair market value, occasional coffee and low-value branded apparel sit in this category.
These gifts fall under a different provision, so they do not count against the $400 or $1,600 caps. You can hand out small items all year and still use the full allowance for formal milestone awards. Cash is never de minimis, no matter how small the amount.
